Overview

Legal and policy studies examine the admissibility of polygraph evidence in courts, the regulatory framework governing polygraph use, ethical considerations in testing, and the intersection of polygraph science with civil liberties. This category bridges the gap between scientific research and real-world application.

Why It Matters

Polygraph admissibility varies dramatically by jurisdiction. In the United States, the Daubert v. Merrell Dow (1993) standard requires scientific evidence to be based on testable, peer-reviewed methodology with known error rates. Most U.S. federal courts exclude polygraph evidence under this standard, though some state courts admit it. The Employee Polygraph Protection Act (1988) prohibits most private-sector polygraph testing.

How to Read These Studies

Legal studies often analyze court decisions, legislative history, and policy frameworks rather than conducting empirical experiments. When they do include empirical data, it is typically drawn from meta-analyses or government reviews. Consider the jurisdiction and legal system (common law vs. civil law) when evaluating the applicability of findings.
