California prohibits polygraph evidence in criminal proceedings under Evidence Code §351.1. However, polygraphs are widely used in PCSOT programs, employment screening for law enforcement, and private investigations.
Workplace polygraph law (EPPA)
Federal EPPA applies. California adds additional employee protections under Labor Code §432.2, prohibiting most private employers from requiring polygraphs as a condition of employment.
