Section Two

The Platform and Service Commencement

2.1Nature of the Platform

2.1.1
The Platform operates as a worldwide online booking service for professional polygraph examination services. Through the Platform, the Company facilitates the connection between Clients seeking polygraph services and independent, qualified Examiners operating across multiple jurisdictions.
2.1.2
The Company does not itself conduct polygraph examinations. The polygraph examination is performed by the assigned Examiner under a separate service arrangement between the Client and that Examiner. The Company’s role is limited to facilitating the booking, administering the Pre-Examination Assessment, and matching the Client with a suitable Examiner.

2.2Commencement of Services

Service Begins Upon Payment: The Company’s service commences immediately upon receipt of the Booking Fee. By paying the Booking Fee, you acknowledge that the Company will begin rendering its services without delay and that you expressly consent to this immediate commencement.

2.2.1
The Company’s service commences upon receipt of the non-refundable Booking Fee. At that point, the Company begins rendering its services by: (a) issuing the electronic Pre-Examination Assessment to the Client for completion; and (b) identifying, vetting, and matching a specialized polygraph service provider whose qualifications, availability, and geographic coverage are suited to the Client’s specific requirements.
2.2.2
The Booking Fee compensates the Company for these administrative, assessment, and matching services, and is earned in full upon commencement of the service. The non-refundable nature of the Booking Fee reflects the fact that the Company begins incurring costs and expending resources immediately upon receipt of payment.

2.3Examiner Relationship

2.3.1
Examiners engaged through the Platform are independent professionals and are not employees, agents, or representatives of the Company. Each Examiner operates under their own professional licenses, certifications, and insurance arrangements.
2.3.2
The polygraph examination itself is conducted under a separate service arrangement between the Client and the assigned Examiner. The Company shall not be liable for the acts, omissions, professional judgments, or conduct of any Examiner, nor for the accuracy, interpretation, or outcome of any polygraph examination.
2.3.3
The Company exercises reasonable care in vetting and selecting Examiners for inclusion in its network. However, the Company does not warrant or guarantee the qualifications, competence, or suitability of any individual Examiner beyond the reasonable checks undertaken at the time of their admission to the network.
Section Three

Terms of Booking

3.1Disclosure and Informed Consent

3.1.1
The Client hereby affirms that they have fully disclosed and presented these Terms to all participating Examinees. The Client further certifies that every individual scheduled to undergo the examination has been informed of the nature, purpose, and procedures of the polygraph examination and has voluntarily given their informed consent to participate.
3.1.2
By proceeding with a booking, both the Client and the Examinee acknowledge that participation in the polygraph examination is entirely voluntary, and that the Examinee may withdraw their consent and discontinue the examination at any time. However, such withdrawal shall not entitle the Client or the Examinee to any refund of fees paid.

3.2Eligibility Requirements

3.2.1
The Client hereby declares that both the Client and the Examinee are at least eighteen (18) years of age at the time of the examination. The Company does not facilitate polygraph examinations on minors under any circumstances.
3.2.2
The Examinee must not have ingested alcohol, consumed illicit drugs, or engaged in the use or abuse of any controlled substances, prescription medications that may impair cognitive or physiological function, or any other intoxicating substances within the twenty-four (24) hour period immediately preceding the scheduled time of the examination. Failure to comply may result in cancellation of the examination with full forfeiture of fees paid.
3.2.3
The Client hereby affirms that the Examinee is not currently pregnant, has not given birth within the preceding four (4) weeks, and does not suffer from any cardiac conditions, including but not limited to conditions requiring blood pressure medication, reliance upon a pacemaker, or any other cardiovascular condition that may be adversely affected by the polygraph examination process.
3.2.4
Should any of the health conditions described in Clause 3.2.3 exist, the Examinee must obtain written clearance from a licensed medical professional prior to the examination. The Examiner reserves the right to refuse to proceed if, in their professional judgment, the Examinee’s health or wellbeing may be at risk.
3.2.5
The Examinee must be of sound mind and capable of understanding the questions posed during the examination. The Examiner reserves the right to terminate the examination if, in their professional judgment, the Examinee is unable to comprehend or respond coherently to the examination process.

3.3Scheduling and Availability

3.3.1
The preferred date and time of a polygraph examination, whether reserved through the Platform, via telephone, or through any other communication channel, is subject to change due to the following contingencies:
(a)Illness, incapacity, or unavailability of either the Examinee or the assigned Examiner.
(b)Unavailability of a suitable, controlled, and professionally adequate examination environment meeting the standards required for the examination.
(c)Technical failure or malfunction of information technology support systems, polygraph instrumentation, or associated equipment.
(d)Any other unanticipated circumstances beyond the reasonable control of the Company or the assigned Examiner not previously specified within these Terms.
3.3.2
In the event of any scheduling changes pursuant to Clause 3.3.1, the Company commits to ensuring that the examination will be conducted by a qualified professional within thirty (30) Business Days from the initially selected test date.
3.3.3
For bookings made with less than forty-eight (48) hours’ notice, the full fee (comprising both the Booking Fee and the Examination Fee) shall be payable immediately upon reservation. All standard Terms herein shall apply without exception.
Section Four

The Examination

4.1Identification and Verification

4.1.1
The Examinee shall present a valid, unexpired, government-issued photographic identification document upon arrival at the examination venue. Acceptable forms include a national identity card, passport, or driver’s license (or equivalent government-issued photo ID recognized in the jurisdiction in which the examination takes place). No other forms of identification will be accepted.
4.1.2
Failure to present valid identification shall result in the immediate cancellation of the examination, full retention of all fees paid, and forfeiture of any option to reschedule.

4.2Professional Environment and Conduct

4.2.1
The Company and its Examiners are committed to maintaining a professional, respectful, and safe environment for all parties. Any act of verbal abuse, physical aggression, threatening behavior, harassment, or intimidation directed toward an Examiner, Company staff, or any other personnel shall result in the immediate termination of the examination, complete forfeiture of all fees paid, and irrevocable loss of the opportunity to reschedule.
4.2.2
Any exposure to or evidence of criminal activity, unethical conduct, attempted bribery, corruption, or any attempt to improperly influence the Examiner or the outcome of the examination shall result in the immediate cessation of the examination, retention of all fees paid, and permanent revocation of the option to rebook. The Company and/or the Examiner reserve the right to report such conduct to the appropriate law enforcement authorities.

4.3Examination Integrity

4.3.1
The deployment or attempted deployment of any Countermeasures during the polygraph examination is strictly prohibited. Upon detection of a first instance, the Examiner shall issue a formal warning. Any subsequent attempt shall result in the immediate termination of the examination, forfeiture of all fees paid, and loss of the rebooking option.
4.3.2
The polygraph examination employs a combination of advanced polygraph testing instrumentation and forensic psychological analysis to assess physiological indicators of deception. The specific methodology and protocols are at the sole discretion of the assigned Examiner, in accordance with standards established by recognized professional bodies such as the American Polygraph Association (APA), the British Polygraph Society (BPS), or equivalent credentialing organizations.

4.4Punctuality

4.4.1
The Examinee agrees to arrive at the designated venue no fewer than fifteen (15) minutes prior to the scheduled examination time. This pre-examination period is essential for administrative procedures, identity verification, and the pre-test briefing.
4.4.2
Failure to arrive within the specified timeframe may, at the sole discretion of the Examiner, result in cancellation of the examination, retention of all fees paid, and forfeiture of the option to reschedule.

4.5Question Parameters

4.5.1
Only closed-ended, issue-specific questions are permissible during the examination. Questions pertaining to personal beliefs, subjective opinions, speculative matters, future intentions, or hypothetical scenarios are not suitable for and shall not be accommodated within the examination framework.
4.5.2
A maximum of eight (8) questions may be posed during the examination, of which between two (2) and three (3) shall be closed-ended questions directly related to the issue under examination. The precise formulation shall be agreed upon between the Client, the Examinee, and the Examiner during the pre-test interview.

4.6Mandatory Reporting Obligations

Mandatory Reporting: In accordance with applicable laws, instances of suspected domestic violence, child abuse, child endangerment, or sexual abuse identified during or arising from the examination shall be reported to the appropriate authorities without exception. This obligation supersedes any expectation of confidentiality.

4.7Attendance and Privacy

4.7.1
No third parties, including legal representatives, family members, friends, or support persons, may be present in the examination room during the conduct of the polygraph test. Third parties are, however, permitted to attend the pre-test interview phase, subject to the Examiner’s approval and provided their presence does not compromise the integrity of the process.

4.8Reporting and Results

4.8.1
Upon completion, a comprehensive written Report will be prepared by the Examiner and delivered to the Client via email. Reports shall ordinarily be dispatched within twenty-four (24) hours following the conclusion of the examination.
4.8.2
Alternatively, the Report may be dispatched within forty-eight (48) hours via tracked postal mail upon specific request at the time of booking.
4.8.3
Immediate verbal disclosure of results on the day of the examination is not standard practice. Verbal results may, at the Examiner’s sole discretion, be provided on the day or delayed if further analysis or quality assurance procedures are deemed necessary.
4.8.4
The results of the polygraph examination are final and non-appealable. Results shall be classified as: No Deception Indicated (NDI), Deception Indicated (DI), or Inconclusive. No refund or credit shall be issued on the basis of the outcome, regardless of the result obtained.

4.9Venue Requirements

4.9.1
Where the Client provides the examination venue, the room must be clean, sanitized, private, free from external noise and interruptions, adequately lit, temperature-controlled, and equipped with necessary furnishings (including a table and two chairs) and access to functioning electrical power.
4.9.2
The Examiner reserves the absolute right to cancel or refuse to proceed if the venue is deemed unsuitable, unsafe, or inadequate. In such circumstances, all fees paid shall be retained.
Section Five

Supporting Documentation

5.1
Any additional supporting documentation requested by the Company in connection with the examination must be received no fewer than forty-eight (48) hours prior to the scheduled examination date. The Company will contact the Client as a courtesy reminder as the deadline approaches.
5.2
Failure to provide the required documentation within the specified timeframe shall result in the automatic cancellation of the booking. All fees paid shall be retained and the option to rebook shall be permanently withdrawn.
Section Six

Fees, Payment, and Financial Obligations

6.1Fee Structure

6.1.1
The financial obligations for the polygraph examination service consist of two distinct charges: the Booking Fee and the Examination Fee, as described below.

Please Note: The Booking Fee and Examination Fee are separate charges. The Booking Fee compensates the Company for its administrative, assessment, and examiner-matching services, and is earned in full upon commencement. The Booking Fee will be deducted from the total cost of the service. The Booking Fee is refunded in full where the Company is unable to arrange a suitable appointment, or where the assigned Examiner determines the case is unsuitable for examination.

6.2Booking Fee

6.2.1
A compulsory, Booking Fee (non-refundable, save as provided in clause 7.3.4) of one hundred US dollars ($100.00) is levied at the time of booking. Upon receipt, the Company immediately commences rendering its services by issuing the electronic Pre-Examination Assessment and initiating the process of identifying and matching a specialized Examiner to the Client’s specific requirements.
6.2.2
The Booking Fee covers the administrative costs of processing and managing the booking, administering the Pre-Examination Assessment, vetting and matching an appropriate Examiner from the Company’s certified network, and securing availability for the Client’s preferred appointment. While this fee is not for the examination itself, it shall be deducted from the total Examination Fee, with the remaining balance payable directly to the appointed Examiner.

6.3Examination Fee

6.3.1
The Examination Fee is variable depending upon several factors, including but not limited to: the geographic location, the number of individuals to be tested, the selected date and time, the complexity of the examination, and the availability of the Examiner.
6.3.2
The Examination Fee is payable directly to the assigned Examiner. The full and remaining balance must be settled within twenty-four (24) hours following acceptance of the Pre-Examination Assessment. The Company will contact the Client as a courtesy reminder as the payment deadline approaches.
6.3.3
If the Company does not receive a response or the outstanding balance is not paid within the twenty-four (24) hour period, the booking shall be subject to automatic cancellation. All fees paid prior to cancellation shall be non-refundable, and the opportunity to reschedule shall be forfeited.

6.4Venue Disclosure

6.4.1
Upon receipt and confirmation of the total payment due, the exact location of the polygraph examination venue shall be disclosed to the Client. This procedure is maintained for security purposes and to uphold examination integrity and confidentiality standards.

6.5Payment Authorization

6.5.1
By executing this Agreement, the Client expressly represents and warrants that they are the lawful cardholder of the credit or debit card utilized for the transaction and possess all necessary legal authority to effectuate electronic card payments using said card.
6.5.2
The Client acknowledges that processing payments without the requisite authority shall constitute an act of fraud under applicable laws. The Company explicitly disclaims any responsibility or liability for unauthorized or fraudulent transactions.
6.5.3
The Client agrees to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, actions, proceedings, losses, damages, costs, and expenses (including reasonable legal fees) arising from unauthorized transactions.

6.6Pre-Examination Assessment

6.6.1
Upon receipt of the Booking Fee, the Client will be provided with the electronic Pre-Examination Assessment via email and SMS. This assessment forms a critical part of the Company’s service, enabling the Company to evaluate the Client’s requirements and match an appropriately qualified Examiner. It is imperative that this be completed and returned within twenty-four (24) hours.
6.6.2
Failure to submit the Pre-Examination Assessment within the specified timeframe shall result in the automatic cancellation of the appointment, and the Booking Fee shall not be refunded.
Section Seven

Cancellation, Rescheduling, and Refund Policy

7.1Cancellation by the Client

7.1.1
In any case of cancellation, the non-refundable Booking Fee may be transferred to a new appointment at no additional cost, provided that written notice is received no fewer than forty-eight (48) hours prior to the scheduled appointment time.
7.1.2
All cancellation requests must be submitted in writing via email to [email protected]. Verbal cancellations via telephone shall not be accepted.
7.1.3
Cancellation requests received fewer than forty-eight (48) hours prior to the appointment shall result in the complete forfeiture of all fees paid, with no option to reschedule or transfer the Booking Fee.

7.2Rescheduling

7.2.1
If the Client wishes to amend the date of their booking, they must provide a minimum of forty-eight (48) hours’ written notice prior to the original appointment date.
7.2.2
The rescheduled appointment must fall within thirty (30) calendar days of the original booking date. Requests beyond this window shall be treated as a cancellation, requiring a new booking with a fresh Booking Fee.

7.3Refund Policy

7.3.1
Once a polygraph examination has been conducted and results provided, no refund shall be due regardless of the outcome—whether classified as No Deception Indicated (NDI), Deception Indicated (DI), or Inconclusive. The results provided are final and conclusive.
7.3.2
Failure to adhere to any provision of these Terms shall result in automatic cancellation of the examination. All fees paid shall be retained, and the option to rebook shall be permanently withdrawn.
7.3.3
Any payment made to the Company is final. These Terms supersede any contrary terms, policies, or chargeback mechanisms of the Client’s bank, banking institution, credit card provider, or creditor, including but not limited to Mastercard, Visa, American Express, Discover, and any other payment network or processor.
7.3.4
Booking Fee refund exception. Notwithstanding clauses 7.3.1 to 7.3.3 and any other provision of these Terms, the Booking Fee shall be refunded in full in the sole event that the Company is unable to accept the Client’s case or is unable to arrange a suitable appointment. Save for this circumstance, the Booking Fee is non-refundable.
Section Eight

Data Handling, Privacy, and Retention

8.1Ownership of Data

8.1.1
All data, polygraph charts, documents, video recordings, voice recordings, and any other materials generated during or in connection with the examination shall remain the exclusive property of the Examiner and/or the Company and shall be handled in accordance with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and any other applicable data protection laws in the jurisdiction in which the examination takes place.

8.2Data Retention and Deletion

8.2.1
If the Client indicates on the Consent Form that they wish for test data to be removed upon conclusion of services, the Company shall, upon production of the Report, automatically delete all data obtained with the sole exception of the polygraph results Report, which shall be retained for one (1) year in accordance with professional association membership obligations.
8.2.2
If the Client does not expressly request data removal, all data relating to video recordings, voice recordings, and polygraph charts shall be automatically deleted within twenty-four (24) hours from production of the Report.
8.2.3
If the Client indicates that recordings are to be used as evidence in a court of law, tribunal, arbitration, or any other legal proceeding, the Company shall retain such data for a maximum period of one (1) year from the date of the examination.
8.2.4
During the retention period, video and voice recordings remain the exclusive property of the Company and/or the Examiner. The Client may view such recordings only in the presence of an Examiner at a controlled office location on a mutually agreed date, subject to covering all reasonable costs. Recordings shall not be released, copied, or distributed to the Client or any third party except as compelled by a court order or formal legal request from a recognized legal body.
8.2.5
The Client must advise the Examiner during the pre-examination interview if they wish for recordings to be retained; otherwise, all recordings shall be deleted within twenty-four (24) hours of the examination.

8.3Mandatory Disclosure

8.3.1
The Company reserves the unequivocal right to disclose any personal information and/or data derived from the examination to law enforcement authorities, child protective services, or other governmental agencies as deemed necessary, in the event that results suggest deceptive responses pertaining to allegations of sexual abuse, child abuse, child endangerment, or domestic violence.
8.3.2
Such disclosure shall be made in compliance with all applicable laws and regulations in the relevant jurisdiction, and is contingent upon the professional assessment of the Examiner that the results bear a significant implication of such conduct. This provision takes precedence over any other confidentiality obligations in these Terms.
Section Nine

Force Majeure and Events Outside of Our Control

9.1
The Company shall not be liable for any failure to perform, or delay in performance of, any obligations under these Terms where such failure or delay results from events beyond the reasonable control of the Company (“Force Majeure Event”).
9.2
A Force Majeure Event includes, without limitation:
(a)Acts of God, including storms, floods, earthquakes, subsidence, volcanic activity, epidemics, pandemics, or other natural disasters.
(b)War, whether declared or undeclared, armed conflict, military action, or threat thereof.

(g)Government orders, sanctions, embargoes, quarantine restrictions, or regulatory actions.
(h)Failure or disruption of utilities, telecommunications, or internet services.
(i)Any other event or circumstance beyond the reasonable control of the Company.
9.3
In the event of a Force Majeure Event, the Company shall contact the Client as soon as reasonably practicable, and the Company’s obligations shall be suspended for the duration of the event.
9.4
Following resolution of a Force Majeure Event, the Company shall confirm a rescheduled appointment date. No refund shall be issued as a consequence of a Force Majeure Event.
9.5
In unforeseen circumstances which the Company agrees to accept, and with a minimum of forty-eight (48) hours’ notice, the Client may reschedule within fourteen (14) calendar days of the original date, and the original Booking Fee shall be applied to the rescheduled booking.
Section Ten

Limitation of Liability

10.1
The polygraph examination is a diagnostic tool and does not provide absolute proof of truth or deception. Neither the Company nor its Examiners make any guarantee, warranty, or representation as to the infallibility or absolute accuracy of results. Results are based on professional interpretation of physiological data and are subject to the inherent limitations of the methodology.
10.2
To the maximum extent permitted by applicable law, the Company’s total aggregate liability arising out of or in connection with these Terms shall in no event exceed the total amount of fees paid by the Client to the Company (being the Booking Fee) for the specific booking giving rise to the claim. For the avoidance of doubt, the Company shall not be liable for any acts, omissions, or professional judgments of any Examiner.
10.3
The Company shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of revenue, loss of business, damage to reputation, emotional distress, or any other damages, regardless of the theory of liability and even if the Company has been advised of the possibility of such damages.
10.4
The Client acknowledges that polygraph results shall not be used as the sole basis for any employment decisions, legal proceedings, or other consequential actions. The Company accepts no liability for decisions made by the Client or any third party based upon the examination results.
10.5
Nothing in these Terms shall exclude or limit the Company’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other matter for which it would be unlawful to exclude or limit liability under the laws of England and Wales.
Section Eleven

General Provisions

11.1Governing Law and Jurisdiction

11.1.1
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
11.1.2
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11.2Severability

11.2.1
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.

11.3Entire Agreement

11.3.1
These Terms, together with the Consent Form and any booking confirmation correspondence, constitute the entire agreement between the Client and the Company and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.

11.4Waiver

11.4.1
No failure or delay by the Company in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise preclude further exercise or the exercise of any other right, power, or privilege.

11.5Assignment

11.5.1
The Client may not assign, transfer, or delegate any rights or obligations under these Terms without the Company’s prior written consent. The Company may assign these Terms in whole or in part to any successor, affiliate, or assignee without the Client’s consent.

11.6Amendments

11.6.1
The Company reserves the right to amend, modify, or update these Terms at any time. Amendments shall be effective upon posting to liedetectortest.com. Continued use of the Platform following amendments constitutes acceptance of the amended Terms.

11.7Notices

11.7.1
All notices, requests, and communications under these Terms shall be in writing and shall be deemed given upon delivery if delivered personally, upon confirmation of receipt if sent by email to [email protected], or upon the expiry of two (2) Business Days after deposit in the postal system, postage prepaid, to the Company’s registered office address.
Section Twelve
